Eligibility criteria for the Gold Visa Program are expected to be finalized within 90 days of the executive order signed on September 19, 2025. However, these details remain subject to change as the regulatory framework is still under development. Preliminary requirements being considered include: 

• Proof of required investment: $1 million for individuals or $2 million for corporate-sponsored applicants 
• Ability to pay the $15,000 vetting fee 
• Clean criminal background and legal source of funds 
• Willingness to comply with U.S. immigration laws and regulations 
• For some programs, demonstration of business experience or intent to create employment in the U.S. may be required 
• Additional requirements may apply based on the country of origin and the current immigration status 

• Establish application process: The USCIS, State Department, and other agencies must create the formal process for submitting and adjudicating Gold Card petitions, including the expedited path for approval. 
• Finalize fees: The agencies need to finalize the specific structure for the $15,000 "vetting fee" and any other administrative or maintenance fees, especially for corporations sponsoring individuals. 
• Release new rules in the Federal Register: The process for making these changes must follow the Administrative Procedure Act, meaning the relevant agencies will propose regulations that must be published in the Federal Register for public review and comment. 
• Issue revised guidance: The agencies must issue new policies and guidance on how the financial "gift" to the Commerce Department will be treated as evidence of "exceptional ability" or "extraordinary ability" for existing visa categories (EB-1 and EB-2). 

• Set start date for gifts: The Department of Commerce must specify the date on which applicants can begin submitting the $1 million (or $2 million for corporate-sponsored) gifts. 
• Create gift fund: The Department of Commerce is directed to create a separate fund within the U.S. Treasury to deposit these financial gifts and use them "to promote commerce and American industry". 
• Determine visa availability: With a stated target of 80,000 cards, the State Department must manage the number of visas issued, ensuring that they fall within the limits set for the existing EB-1 and EB-2 visa categories. 
• Address sponsor transfers: A process needs to be established for corporations that sponsor an employee to transfer the card's sponsorship to another employee if the original holder's status is abandoned.
